HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.37881 of 2016 Order:

This Writ Petition was filed challenging the action of the second respondent in registering the FIR No.85 of 2016 dated 04.07.2016 on the file of Madanapalle I-Town Police Station, Chittoor district against the petitioner.

The second respondent filed a counter stating that the third respondent lodged a complaint on 04.07.2016 stating that during the enquiry conducted by them it was noticed that there was misappropriation of funds and huge loss was caused to the Government. Crime No.85 of 2016 was registered under Sections 465, 468, 420 and 408 read with 34 IPC. The investigation in the said crime is pending. It is also stated that unless full fledged investigation is conducted it cannot be said that the petitioner has nothing to do with the criminal overt acts in the commission of offence.

Since the crime was registered on the basis of the complaint made by the third respondent and investigation is pending, this Court is not inclined to entertain the present Writ Petition. It cannot be said that registering of Crime No.85 of 2016 dated 04.07.2016 by the second respondent is bad in law.

In the circumstances, the Writ Petition is dismissed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
