HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9070 OF 2017 ORDER:
The case of the petitioners is that the 4th respondent filed application for online issuance of the pahanies in her favour pertaining to the lands admeasuring Ac.2.38 guntas in Survey No.429/A, situated at Thimmapur Village, Chendurthi Mandal, Rajanna Sircilla District, for which petitioners are already having pattadar pass books and title deeds and filed objections on 25.07.2016. Thereafter, petitioners were also issued notice dated 24.12.2016.
But, the petitioners apprehend that without considering their objections, the 2nd respondent is going to dispose of the application of the 4th respondent and filed this writ petition. Heard both sides.
As on today, no order is passed by the 2nd respondent. The writ petition is filed only on apprehension. According to the petitioners, as the 2nd respondent has already issued notice to the petitioners the 2nd respondent is obligated to consider the objections of the petitioners. In view of the same, the writ petition is disposed of directing the 2nd respondent to consider the objections of the petitioners and give opportunity of hearing before disposing the application of the 4th respondent, provided orders are not passed. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
