HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5842 of 2014 ORDER :

This criminal petition is filed by the petitioner/accused No.3 under Section 482 Cr.P.C to quash the proceedings in Crime No.138 of 2014 of Amalapuram Town Police Station, East Godavari District registered for the offences punishable under Sections 420, 406 and 506 read with 34 I.P.C.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed the charge sheet after investigation and the petition since filed against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. Needless to say the further remedy, if any, including filing of Rule 37 of Criminal Rules of Practice to represent one on behalf of all other accused, is left open to the accused.

4) Miscellaneous petitions, if any pending, shall stand closed.
