Heard.
The present writ petition is filed with a grievance that respondents 1 and 2 are trying to accord permission to the 3rd respondent to run a toddy shop in the compound of the 4th respondent. The said relief sought for by the petitioner is on the ground that the proposed toddy shop is within the residential area and it is very close to a recognized school already established in the said residential locality.
When the writ petition has come up for consideration on 30-12-2014, the learned Government Pleader was required to get instructions.
Learned Government Pleader has received instructions from the 2nd respondent, which state that no toddy shop proposals have been received by the office of the 2nd respondent with regard to the premises bearing No.18-5-116 to 120, Laldarwaza, Hyderabad and consequently, no toddy shop licence was granted in respect of the said premises till date.
Learned Government Pleader states that since there is no application by any licencee, the allegation of the petitioner that any toddy shop is being established is factually incorrect. In view of that, no further orders are required to be passed in this writ petition. However, as and when any such apprehended action takes place, the petitioner is at liberty to invoke appropriate remedy before appropriate forum.
Subject to the aforesaid liberty, the writ petition is disposed of. No order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
