THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 23706 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents in not releasing the power supply to the property of the petitioner bearing H.No.11-1-142; 11-1-142/1; and 11-1-142/2, situated at Raithu Bazar, Bharathnagar, Siddipet District, Siddipet, and in insisting for production of 'Occupancy Certificate' from the 4th respondent-Municipality. Heard learned counsel for the petitioner, Sri R.Vinod Reddy, learned Standing Counsel for respondents 1 to 3- Southern Power Distribution Company Limited of Telangana and Sri N.Praveen Kumar, learned Standing Counsel for 4th respondent-Municipality.

All the learned counsel submitted that the subject matter in the present writ petition is squarely covered by the order passed by this Court in WP.No.35467 of 2017, dated 25.10.2017, and hence the same may be disposed of in terms of the said order.

Having regard to the facts and circumstances of the case, and the submissions of the learned counsel, and for the reasons alike in the order passed in the above stated writ petition, the present writ petition is disposed of with a direction to the respondents 1 to 3 to release the power supply to the subject property of the petitioner, subject to compliance of terms and conditions of supply, and on furnishing an undertaking to produce the

Occupancy Certificate from the concerned Municipality/Municipal Corporation, within a period of six months.

It is made clear that if no such occupancy certificate is produced within such period, it is open to the said respondents to take appropriate action in accordance with law for withdrawal of power supply. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
