HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 31653 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No. 20 of Surareddypalem village & Mandal, Prakasam district. On a complaint made by the Janmabhoomi Committee of Surareddypalem village, the Tahsildar, Tanguturu Mandal submitted a report to the third respondent on 20.6.2015 alleging certain irregularities against the petitioner. A show cause notice was issued to the petitioner on 23.6.2015 based on the said report and the petitioner submitted his explanation on 1.8.2015. After considering the same, the third respondent passed an

order on 28.8.2015 suspending the authorization of the petitioner. Challenging the same, the petitioner preferred an appeal to the second respondent on 7.9.2015. When the second respondent did not take up the appeal, the present Writ Petition is filed.

In view of the pendency of the appeal before the second respondent, this Court is not inclined to enter into the merits or otherwise of the subject matter. In view of the pendency of the appeal preferred by the petitioner on 7.9.2015, the second respondent is directed to consider the appeal and pass appropriate orders within a period of thirty days from the date of receipt of a copy of this order after affording due opportunity to the petitioner, since the appeal is directed against the order of suspension passed by the third respondent.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
