THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26003 OF 2017 O R D E R:

Proceedings of the 3rd respondent Assistant Provident Fund Commissioner, dated 10.03.2017 and consequential notices issued for recovery of an amount of Rs.12,77,279/-, is challenged in this Writ Petition.

Heard learned counsel for the petitioner as well as Sri T. Balaji, learned Standing Counsel for Respondents 2 and 3 Employees Provident Fund Organization.

It is admitted by both the learned counsel that against the order impugned, a statutory Appeal under Section 7-I of the Employees Provident Fund and Miscellaneous Provisions Act, 1952, has been provided.

In view of the same, without going into the merits of the matter, the Writ Petition is disposed of leaving liberty to the petitioner to avail the remedy of Appeal under Section 7-I of the Act. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
