THE HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.23225 of 2007 ORDER:

This writ petition, filed under Article 226 of the Constitution of India, challenges inaction on the part of the respondents in not considering the application/ representation, dated 01.04.2007, for removing encroachments on road margin and drain in between the petitioner's site covered by RS No.780/1 and 780/3 of Kamavarapukota Village and the State Highway No.44 leading from Eluru Road to Jangareddygudem, said to have been submitted by the petitioner as illegal arbitrary and violative of provisions of the Land Encroachment Act, Andhra Pradesh Panchayat Raj Act, the Rules framed thereunder.

Heard learned counsel for the petitioner, learned Government Pleader for Forest appearing for respondents 1 to 4 and Sri Ravi Cheemalapati, learned Standing Counsel appearing for respondent No.5.

The grievance precisely in the present writ petition is, inaction on the part of the respondent authorities in taking any action on the representation, dated 01.04.2007, submitted by the petitioner for removal of encroachments.

No counter affidavits have been filed by the respondents herein.

In the circumstances, this Court is inclined to dispose of the present writ petition basing on the material available on record.

Accordingly, the writ petition is disposed of, directing the

respondents 3 to 5 to take appropriate action on the representation, dated 01.04.2007, said to have been submitted by the petitioner in accordance with law within a period of three months from the date of receipt of a copy of this order. No costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
