HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 21985 of 2005 O R D E R:- This writ petition is filed seeking to issue a writ of Mandamus declaring action of the 1st respondent in not considering the case of the petitioner for promotion to the post of Deputy Executive Engineer, as arbitrary and illegal. A consequential direction is sought to direct the respondents to promote the petitioner as Deputy Executive Engineer. When the matter is taken up for hearing, Sri G.Seena Kumar, learned Standing Counsel appearing on behalf of the respondents, submits that the petitioner's case was considered and he was promoted as Deputy Executive Engineer and he has been working as such with effect from 03.03.2014 vide Proceedings No.E2/ 3126/ APEWIDC/ 2013, dated 10.04.2018 issued by the Managing Director, Andhra Pradesh Education & Welfare Infrastructure Development Corporation and the said fact is not disputed by the learned counsel for the petitioner.

In view of the same, the cause in this writ petition no longer survives and the matter has become infructuous. Hence, the writ petition is dismissed as infructuous. No order as to costs.

AKS,J WP_21985_2005 As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
