THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6680 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A4 seeking bail in the event of his arrest in connection with Crime No.67 of 2022 on the file of Sujathanagar Police Station, B.Kothagudem District, registered for the offences punishable under Sections 498 A of Indian Penal Code and under Sections 3 & 4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioner is that the petitioner is Accused No.4 who is brother of Accused No.1. The defacto complainant is the father-in-law of Accused No.1 who filed a complaint on 26.05.2022 stating that Accused No.1 and his family members were harassing his daughter physically and mentally and also abusing her in filthy language; and that Accused No.1 forced her daughter to swallow 30 Paracetamol pills and demanded additional dowry. 4.

Learned Counsel for the petitioner submits that this petitioner/A4 was falsely implicated; and that he was married and living separately.

In view of the aforesaid facts and circumstances, this petitioner/A4 can be granted the relief of anticipatory bail in the event of his arrest, subject to the following conditions:

1) The petitioner/A4 is directed to surrender directed to surrender before the Station House Officer, Sujathanagar Police Station, B.Kothagudem District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A4 on bail, on his executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A4 shall appear before the concerned police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of two months, for the purpose of investigation.

3) The petitioner/A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
