THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10197 of 2015 ORDER:

The petitioner challenges the notice dated 09.02.2015 issued by the 2nd respondent-Revenue Divisional Officer.

2. The averments in the writ affidavit are to the effect that the 4th respondent made a representation before the 2nd respondent alleging that the pattadar passbooks were granted in favour of the petitioner in exclusion of himself and other family members who are also entitled to a share in the property in an extent of Ac.5-00 cents in Survey No.380-2 of Mangalamadaka village, Mudigubba mandal, Anantapur district.

3. Heard the learned counsel for the petitioner as well as the learned Government Pleader.

4. As the impugned notice is only a notice intimating about the petition filed by the 4th respondent and calling upon the petitioner to attend the enquiry before the 2nd respondent, I am not inclined to entertain the writ petition. However, liberty is given to the petitioner to raise all the objections before the 2nd respondent, including that of limitation and other jurisdictional issues as to how and in what manner the 2nd respondent is not entitled to entertain the representation of the 4th respondent. As and when such objections are filed by the petitioner, the 2nd respondent shall consider the same and deal with every aspect of the objections objectively and pass

necessary orders, in accordance with law.

5. With the above observations, the writ petition is disposed of. No order as to costs.
