THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITIOIN No.2226 of 2008 ORDER:

According to the petitioner, it is an association registered under the Societies Registration Act 21 of 1860 formed for the development of Jaganmatha Maremma Temple.

Earlier one Sri S.Narasimhulu, S/o Narsimhulu, claimed to be Secretary of the petitioner-association, filed W.P.No.11379 of 2002 before this Court seeking a direction to the respondents for removal of the encroachments made by respondent Nos.5 to 7 therein.

This Court, by way of an order, dated 18.3.2004, directed the District Collector, Kadapa, to treat the said Writ Petition as a representation and to take appropriate decision thereupon in accordance with law, if necessary, after holding enquiry, if any. According to the learned counsel for the petitioner, despite the said direction, respondents did not take any action. In the present Writ Petition, on 26.02.2016 in W.P.M.P.No.2871 of 2008, this Court passed an interim order directing the respondents to take steps for removal of the encroachments for development of the subject temple.

No counter-affidavit is filed. In view of the same, having regard to the nature of the controversy and taking into consideration the submissions of the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition by making the said interim order as a final order.

The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
