HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15722 of 2017 ORDER:

The Writ Petition is filed questioning the inaction of respondent Nos.1 and 2, in considering representations of the petitioner dated 03.04.2017 and 16.01.2017, for removal of unauthorized constructions raised by respondent No.3, contrary to the sanctioned plan, in premises bearing Nos.7-1-238/1 and 7-1-238/2, Balkampet, Hyderabad, as being illegal and arbitrary. Petitioner states that respondent No.3, having obtained permission for construction of stilt + 5 floors, has unauthorizedly converted cellar into commercial floor by constructing shops; and no set backs were maintained as per the sanctioned plan.

He, therefore, made representations dated 03.04.2017 and 16.01.2017 to respondent No.2 for taking necessary action. As no action has been taken, the Writ Petition has been filed. Sri P.Kesava Rao, learned Standing Counsel for respondent Nos.1 and 2, on instructions, would submit that the representations made by the petitioner would be considered and, if any, illegal constructions are made, necessary action would be taken by respondent Nos.1 and 2 in accordance with law.

In the circumstances, Writ Petition is disposed of with a direction to respondent Nos.1 and 2 to consider the petitioner's representations dated 03.04.2017 and

16.01.2017 and, if any illegal constructions are found, take action in accordance with law.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
