THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6307 OF 2017 O R D E R :
The case of the petitioner is that he has been engaged in the business of purchase and sale of black jaggery. It is stated that during the course of the said business, while the petitioner was transporting 272 bags of black jaggery, the 3rd respondent intercepted the said vehicle on 01.09.2015 and registered a case in PCOR No. 459 of 2015-16 for the offence punishable under Section 34(e) of the A.P. Excise Act, 1968. The petitioner therefore, filed a Petition before the 2nd respondent Deputy Commissioner of Prohibition & Excise, Mahaboobnagar Division on 29.11.2016 seeking interim custody of the stock. The 2nd respondent granted interim custody of the vehicle on 18.11.2016, but however, the Petition dated 29.11.2016 has not been considered and stock has not been released so far. Hence, this Writ Petition. Heard learned counsel for the petitioner and learned Government Pleader for Prohibition & Excise.
Since the grievance of the petitioner being limited, this Court deems it appropriate to direct the 2nd respondent to consider and pass appropriate orders on the Petition dated 29.11.2016 filed by the petitioner, within seven days from the date of receipt of a copy of this order. Ordered accordingly.
With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
