THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 27679 of 2015 ORDER:
The petitioner is a license holder and doing business in fertilizers. On 28.01.2015, the Agricultural Extension Officer along with Mandal Agricultural Officer inspected the premises and seized the available stock on the ground of certain irregularities. The petitioner filed W.P.No.3672/2015 challenging the said action and the same was disposed of on 19.02.2015 directing the 2nd respondent to consider the application of the petitioner dated 04.02.2015 within a week. Again he submitted another application on 18.08.2015. The 2nd respondent issued an endorsement on 11.03.2015 rejecting the request of the petitioner for release of the seized stock on furnishing a Bank Guarantee of 10% value of the seized stocks. Challenging the same, the present writ petition is filed.
Though the present writ petition is filed challenging the said endorsement, learned counsel for the petitioner submits that till today, the seized stock was not disposed of to the needy farmers. In view of long lapse of time from the date of seizure till date, the 2nd respondent is directed to disposed of the 6 A proceedings pending before him in ECP.No.19/2015 within a period of three (03) months from the date of receipt of copy of the order. In view of the disposal of the writ petition, in the manner indicated above, if the stocks was not already disposed of, the same shall be kept pending till the passing of the orders by the 2nd respondent.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
