THE HONOURABLE SRI JUSTICE S. RAVI KUMAR TR.C.M.P No.87 OF 2013 ORDER:

This petition is filed to withdraw O.P.No.1 of 2013 from Senior Civil Judge, Gooty, Anantapur, and transfer the same to Family Court, Kadapa.

Wife filed this petition and according to her affidavit, her marriage with respondent was performed on 12.08.1998 at Tirumalapuram Village and after marriage she joined respondent and led married life for some time and a child was born on 31.03.2000. She stated that from 2003 onwards, ill feelings were developed between them and she was forced to stay at her parents' house and that she is a resident of Brahmanapalli Village Pulivendula Mandal, Kadapa District. She stated that in order to harass her, respondent filed O.P., before Senior Civil Judge, Gooty, which is 130 kilo meters away from her village. She stated that it is difficult for her to travel from her native place to Gooty by incurring huge expenditure for every adjournment. She stated that she has to look after her son, who is aged about 12 years, and for these reasons, she prayed for transfer of O.P.No.1 of 2013 from Senior Civil Judge, Gooty, Anantapur, to Family Court, Kadapa.

Respondent in spite of service of notice, neither appeared in person nor through any advocate.

Heard advocate for petitioner.

Considering the affidavit averments of petitioner which remained unchallenged and also taking the convenience of wife into consideration, O.P.No.1 of 2013 is withdrawn from Senior Civil Judge, Gooty, Anantapur, and transferred to Family Court, Kadapa for

disposal in accordance with law.

Accordingly, Transfer C.M.P. is ordered.
