THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.5941 of 2017 ORDER:

This petition is filed by the petitioners/A1 and A2 under Sections 437 and 439 of Cr.P.C. seeking regular bail in Cr.No.58 of 2017 of Cherla Police Station wherein the petitioners/A1 and A.2 and others allegedly committed offences punishable under Sections 8 (i) (ii) of the TSPS Act, Sections 10, 13 & 39 of the UAP Act and Section 5 of the ES Act.

Learned Additional Public Prosecutor opposed the bail and submitted that investigation is pending and some of the accused i.e., A3 to A8 are absconding and only three witnesses are so far examined and thus, prayed to dismiss the application. Having regard to the gravity of the offences with which, the accused are charged i.e., 8 (i) (ii) of the TSPS Act, Sections 10, 13 & 39 of the UAP Act and Section 5 of the ES Act and also due to pendency of investigation, it is not a fit case to grant bail to the petitioners/A.1 and A.2.

Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous applications pending, if any, shall stand closed.
