- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1842 OF 2017 ORDER :

This Court suspended the notice dated 04.07.2017, by order dated 24.07.2017 in W.P.M.P.No.30110 of 2017 in W.P.No.24320 of 2017. However, on 02.08.2017 final orders are passed in pursuant to the notice suspended by this Court. Alleging disobedience of the directions issued, this Contempt case is filed. 2.

According to learned counsel for the petitioner on 02.08.2017, petitioner submitted a representation enclosing the copy of order and inspite of receipt of the order copy, final orders cancelling the regularization is passed and the same is ex-facie, illegal. However, learned counsel also fairly submits that having realized the mistake in passing the order, contrary to the order of this Court, the Superintending Engineer, passed order on 08.09.2017 keeping his earlier decision dated 02.08.2017 in abeyance, pending outcome of the decision in W.P.No.24320 of 2017.

Learned counsel therefore fairly submits that in view of the subsequent decision of the Superintending Engineer, this contempt case can be closed.

According to the averments in Para 18 of the counter affidavit, the cancellation orders were dispatched on 02.08.2017, but soon after having realized that it was a mistake, the same was withdrawn.

In view of the subsequent order and recording the submission of learned counsel for the petitioner this Contempt Case is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
