THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.6864 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.1 and 2 seeking to quash the proceedings against them in C.C.No.510 of 2019 on the file of I Additional Judicial Magistrate of First Class, Mancherial.

Heard the learned counsel for the petitioners/Accused Nos.1 and 2, the learned Additional Public Prosecutor representing the 2nd respondent-State and perused the record.

Though learned counsel for the petitioners filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioners/Accused Nos.1 and 2 before the Court below. 4.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioners, without expressing any opinion on the merits of the case, the personal appearance of the petitioner/Accused No.2 in C.C.No.510 of 2019 on the file of I Additional Judicial Magistrate of First Class, Mancherial, is only dispensed with, while permitting him to make his appearance through counsel. However, the petitioner/Accused No.2 shall appear before the Court below as and when his personal appearance is so warranted, in respect of the aforesaid Calendar Case. The petitioner/accused No.1 shall appear before the Court below on each and every date of adjournment in respect of the subject Calendar Case.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
