Heard learned counsel for petitioner and learned Government Pleader for Revenue.

M/s. Shriram Chits Pvt Ltd filed Arbitration Case in ABR/CR Mo.801 /2014 against petitioner and others for recovery of Rs.21,08,039/- with interest at 12 % per annum and court cost in respect of Chit Ticket No. 13 in Chit Group HRD 06 for the value of Rs.50,00,000/-. The Arbitrator passed award granting the prayer sought for. Aggrieved thereby, petitioner filed Appeal No. 21011 of 2016 before first respondent. It appears, initially stay was granted by the Appellate Authority but subsequently stay was not extended. Grievance of the petitioner is that even though he has filed application for extension of stay, neither extension of stay was granted nor Appeal is disposed of. On the contrary, respondent company is proceeding for execution of the Award passed by the Arbitrator and in such an event, grave prejudice would be caused to the petitioner. Copies of the appeal, various orders passed by Appellate Authority are filed in the writ petition paper book as material papers.

In view of the above, without expressing any opinion on the merits of the matter, Appellate Authority is directed to dispose of Appeal No. 21011 of 2016 pending before it expeditiously, preferably within a period of six weeks from the date of receipt of copy of this order, by affording opportunity of hearing to petitioner and third respondent company.

Accordingly, writ petition is disposed of.
No costs.
