THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Appeal No.199 of 2010 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order of the learned Single Judge in W.P. No.4014 of 2010 dated 23.02.2010.
By the order under appeal the respondents were directed to complete the enquiry as expeditiously as possible, preferably within a period of two months from the date of the order; and, till conclusion of such enquiry, they were directed not to make any permanent arrangement in the place of the petitioner. The learned Single Judge, however, made it clear that the order did not preclude the respondents from making any temporary arrangement to supply essential commodities to the cardholders. Aggrieved thereby, the present appeal.
The order impugned in the writ petition is an order passed by the Revenue Divisional Officer suspending the authorisation of the appellant in respect of Fair Price Shop No.1 of Thummalagudem Village, Ramannapet Mandal, Nalgonda District pending enquiry. By order dated 15.04.2010 this Court granted interim suspension as prayed for and, as a result, the order of the learned Single Judge has remained suspended ever since. Consequently, the appellant is running the fair price shop till date. Sri S.Lakshma Reddy, learned counsel for the appellant, would submit that the enquiry has since been completed. As the enquiry has now been completed, and the appellant has been continued as a fair price shop dealer by virtue of the aforesaid
interim order, it would suffice to dispose of the Writ Appeal directing the respondents to take necessary action, in accordance with law, pursuant to the enquiry report.
The Writ Appeal is disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
