HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5952 of 2015 O R D E R :

The petitioners, who are accused Nos.1 and 2 in Crime No.20 of 2015 of Dumbriguda Police Station, Visakhapatnam, registered for the offence punishable under Section 20(B) of NDPS Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The case of the prosecution is that on certain information, the Sub-Inspector of Dumbriguda Police Station reached Jaipur Junction at Araku Valle to Paderu road and found two Scorpio Vehicles proceeding and when he tried to stop them, the drivers did not stop and drove the vehicles rashly and that he could not apprehend them as he could not reach their speed and that ultimately the said two vehicles proceeded towards hill and that when there was no way to go further, the drivers of the said vehicles left them there and vanished into the hills and that when the Sub-Inspector procured the presence of MDO and conducted a panachanama it was found that two vehicles contained 300 K.Gs. of ganja and that in one of the vehicles the registration certificate was found in the name of the 1st petitioner.

In view of heavy quantity of ganja of 300 K.Gs. has

been seized, it is not a fit case to grant anticipatory bail to petitioners-accused Nos.1 and 2.
