THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.35512 OF 2013 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed questioning the order, dated 20.11.2013, passed by respondent No.3 under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, 'the Act').

During the course of hearing, it is brought to our notice that against the order passed by the Debts Recovery Tribunal, Visakhapatnam, in an application filed under Section 17 of the Act, the matter was carried in appeal before the Debts Recovery Appellate Tribunal, Kolkotta, and the same is pending in S.A.No.16 of 2014. As much as the petitioners have already filed appeal against the final orders passed under Section 17 of the Act before the Debts Recovery Appellate Tribunal, Kolkotta, petitioners are not entitled to the relief as sought for in this Writ Petition at this stage.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioners to pursue the appeal filed in S.A.No.16 of 2014. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs. ______________________ R. SUBHASH
