THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5964 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This is one of the frivolous applications we have never come across. For the reasons set out therein the learned Arbitrator in exercise of his power under the Arbitration and Conciliation Act, 1996 overruled the question of his own jurisdiction and passed the impugned order, which is sought to be challenged under the writ jurisdiction. It is very clear that sub-sections (5) and (6) of Section 16 of the Arbitration and Conciliation Act, 1996 provide the remedy. Therefore, this writ petition is dismissed with costs assessed at Rs.500/- (Rupees Five hundred only) to be payable by the petitioner to the High Court Legal Services Committee.

Pending miscellaneous petitions, if any, shall also stand dismissed.
