HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.4884 of 2017 ORDER:

This writ petition is filed challenging the proposed action of the respondents for demolition of the structures made by the petitioners in Sy.Nos.172/1 & 172/2, Hydernagar village, Balanagar Mandal, Ranga Reddy District, without disposing of the applications made by the petitioners for regularization.

The case of the petitioners is as follows:
The petitioners purchased an extent of Ac.0.08 gts each in the above Sy.No.172/2, Hydernagar under three sale deeds and thereafter, they constructed buildings therein in the year 1987 after obtaining necessary permission from Grampanchayat, Hydernagar. In the year 2005, a notice was issued by the 3rd respondent, for which a reply was given. A final notice was given on 21.4.2005 asking the petitioners to submit all necessary permissions and documents. Challenging the notices, the petitioners filed W.P.No.7625/2005. This Court disposed of the said writ petition permitting the petitioners to submit all documents within a period of six months, and directing that any action to be taken should be followed by a notice. Meanwhile, the Government notified Building Regularization Scheme and LRS scheme.
Under the said schemes, the petitioners made applications. Further, the Government issued G.O.Ms.No.166, dated 16.2.2008 for getting regularization of the Government land in the occupation of private individuals. The petitioners made applications. The said applications are still pending. The petitioners also made applications for Building Regularization under the new scheme and the said applications are also kept pending.

When this matter has been taken up, Sri Sampath Prabhakar Reddy, learned Standing Counsel for G.H.M.C., submitted that the applications of the petitioners for regularization are under consideration, and the said applications will be considered and appropriate orders will be passed in accordance with law.

Recording the above submission, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
