HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3191 of 2015 ORDER:

This revision is filed by the petitioner-accused challenging the order dated 10.12.2015 passed in Crl.M.P.No.13 of 2015 in Crl.A.No.159 of 2015 by the III Additional Sessions Judge, Rajampet, Kadapa District. The petitioner was convicted and sentenced to undergo simple imprisonment for a period of one year and to pay compensation of Rs.4,00,000/- to the complainant, in default to suffer simple imprisonment for a period of three months in C.C.No.112 of 2011 vide judgment dated 5.11.2015, by the Judicial Magistrate of First Class, Railway Kodur. Aggrieved by the same, the petitioner filed the above Criminal Appeal. Along with the appeal, the petitioner filed the above Crl.M.P. seeking to suspend the conviction and sentence of imprisonment and the payment of compensation. The lower appellate Court dismissed the said Crl.M.P., on the ground that the petitioner has not deposited the compensation amount. Hence, the petitioner filed this revision.

Heard and perused the material available on record. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The sentence of imprisonment imposed by the trial Court against the petitioner-accused is suspended till disposal of the appeal and the petitioneraccused shall be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Judicial Magistrate of First Class, Railway Kodur. The order of compensation passed by the trial Court is also suspended till disposal of the above Criminal Appeal."

Accordingly, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
