HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.781 of 2014 ORDER:

This writ petition is filed seeking the following relief :- " .....to issue an order or direction more particularly one in the nature of writ of Mandamus to declare the action of respondents Nos.2 to 4 in not taking action against the respondents 6 and 7 in misusing the funds and alienating the properties of the 5th respondent Society by entering into an agreement of sale is illegal, arbitrary and in violation of A.P. Societies Act 1964 and consequently direct the respondents 2 to 4 to take appropriate action......" .

Heard Mr.Krishna Kishore Kovvuri, learned counsel appearing for the petitioner and the learned Government Pleader for Revenue appearing for the respondents.

It has been contended by the petitioner that respondents 6 and 7 are illegally selling away the properties of the 5th respondent and in those circumstances, he has submitted a representation to respondents 2 to 4 for taking appropriate action against respondents 6 and 7. But, so far, respondents 2 to 4 have not passed any orders on the said representation nor taken any action against respondents 6 and 7.

Learned counsel appearing for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and pass appropriate orders in accordance with law. Learned Government Pleader appearing for the respondents contended that the respondents 2 to 4 would consider the case of

the petitioner, in accordance with law, if he submits a fresh representation.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to respondents 2 to 4 within a period of two weeks from the date of receipt of a copy of this order. Upon such representation being received, respondents 2 to 4 shall consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter. With the above observations, this writ petition is disposed of. No order as to costs.
