THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU CENTRAL EXCI SE APPEAL No.63 OF 2006 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) The Commissioner of Central Excise and Service Tax, Kakinada Commissionerate, addressed letter dated 16.05.2017 to the Registry stating that this appeal involves duty less than the monetary limit of Rs.20.00 lakh fixed by the Central Board of Excise and Customs vide instructions dated 30.12.2016, which would be applicable to all pending appeals, and therefore the Excise authorities may be permitted to withdraw the appeal on that ground.

The appeal is accordingly dismissed as withdrawn. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
