HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TR.C.M.P. Nos.532 & 604 of 2013 COMMON ORDER:

Tr.C.M.P.No.532 of 2013 is filed by the petitioner/husband for transfer of F.C.O.P.No.858 of 2013 from the file of Judge, Family Court, Visakhapatnam to the Additional Family Court at Hyderabad.

2. Tr.C.M.P.No.604 of 2013 is filed by the petitioner/wife for transfer of O.P.No.1191 of 2013 from the file of Family Court, City Civil Court, Hyderabad to the Family Court, Visakhapatnam to be tried along with F.C.O.P.No.858 of 2013.

3. At the time of arguments, both the counsel submitted that the petitioner in Tr.C.M.P.No.532 of 2013 is working as Software Engineer in Pune and the petitioner in Tr.C.M.P.No.604 of 2013 is working as Lecturer in Government College, Bhadrachalam, Khammam District. They further submitted that both the matters may be transferred to the Family Court, Vijayawada in view of nature of employment of both the parties as well as to avoid inconvenience for both.

4. Both the counsel requested to dispense with the presence of both parties in F.C.O.P. No.858 of 2013 and O.P.No.1191 of 2013 for each and every date of adjournment.

5. Having regard to the facts and circumstances of the case and in view of nature of employment of both parties, F.C.O.P.No.858 of 2013 is withdrawn from the file of Judge, Family Court, Visakhapatnam and O.P.No.1191 of 2013 is withdrawn from the file of the Family Court, City Civil Court, Hyderabad and both are transferred to the Family Court, Vijayawada, Krishna District.

The Family Court, Vijayawada is hereby directed to dispense with the presence of the petitioners in F.C.O.P.No.858 of 2013 and O.P.No.1191 of 2013 for each and every date of adjournment. However, they shall appear as

and when the Court feels that their presence is so required. No costs. Accordingly, both the Transfer Civil Miscellaneous Petitions are disposed of. No costs. As a sequel, miscellaneous petitions, if any filed in these civil miscellaneous petitions, shall stand closed. _________________________ T.SUNIL CHOWDARY, J.
