HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CRP No.2358 of 2010 ORDER:

This civil revision petition is filed against the order dated 23-04-2010 passed in EP No.8 of 2008 in OS No.117 of 2003 by the Vth Addl. Senior Civil Judge, (FTC), Visahkapatnam. By the order impugned, the trial Court having allowed the EP, sentenced the petitioner to undergo imprisonment for realization of the decretal amount.

This Court by order dated 11-06-2010 granted stay of the impugned order on condition the petitioner depositing half of the decretal amount, within a period of six weeks from the date of the order. Now learned counsel for the petitioner states that the conditional order passed by this Court has been complied with and the petitioner is ready and willing to pay the remaining decretal amount in a reasonable time. This submission of the learned counsel

for the petitioner is not seriously objected by learned counsel for the respondent.

In the circumstances, the civil revision petition is disposed of permitting the petitioner to deposit the balance decretal amount due and payable within a period of two months from the date of receipt of a copy of this order. In default, it is open for the respondent to approach the trial Court for execution of the impugned order. Miscellaneous petitions, if any pending shall also stand disposed of. No order as to costs.
