Learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner is wife of freedom fighter late Sri B Lakshmaiah. Taking note of the contribution made by late freedom fighter and on application made by petitioner, 80 sq. yards of house plot was assigned to her vide proceedings dated 14.9.2015. Not satisfied with the extent of house site assigned to her, she seems to have made representations and thereafter filed WP No. 11729 of 2015. The said writ petition was dismissed as withdrawn on 15.10.2019. This writ petition is instituted praying to grant similar relief as sought for in WP No. 11729 of 2015. In the order dated 15.10.2019, no liberty was granted for institution of fresh writ petition.

Though, no successive writ petitions can be filed on same cause of action, having regard to the age of the petitioner and fact that she is wife of a freedom fighter, primarily matter is looked into with reference to her entitlement for allotment of larger extent of house plot than what was given to her. Government notified G.O.Ms. No. 185 Revenue (Assn-I) Department dated 11.3.1997 to allot agricultural land or house plot, as the case may be, to the freedom fighters. In terms of paragraph 3.3 and 3.4, house sites can be allotted to freedom fighters to maximum extent of 300 sq yards. In other words, maximum extent is 300 sq yards, within that limit any extent can be assigned. Further, scheme envisages assignment of house plot to freedom fighters and in the present case, house plot of 80 sq yards was assigned to wife of freedom fighter.

Having regard to the above facts, writ petition is not maintainable and accordingly the same is dismissed. Miscellaneous petitions, if any pending, are closed.
