HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITON No. 17681 of 2006 O R D E R:

This writ petition is filed seeking a writ of Certiorari calling for records connected to and pertaining to the order dated 23.02.2006 passed in M.P.No.62 of 2003 by respondent No.5Labour Court, Guntur, and quash the same as illegal and arbitrary. Learned counsel for petitioners submits that respondent No.5-labour court without appreciating the merits of the case in a mechanical way dismissed the MP and the same is liable to be set aside.

This Court, having perused the order impugned, is of the considered view that respondent No.5 has rightly dismissed the MP on the ground that the cause raised therein cannot be adjudicated or decided under Section 33 C (ii) of the Industrial Disputes Act. Hence, there are no merits in the writ petition and the same is liable to be dismissed.

AKS, J WP_17681_2006 Accordingly, the writ petition is dismissed. No costs. Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
