HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20579 of 2018 ORDER: (Oral) (Per Suresh Kumar Kait, J) The prayer of the petitioners in this case reads as under: "The Hon'ble Court may be pleased to issue a Writ, order or direction more in the nature of Mandamus declaring the action of the respondents particularly APPSC in revising the selection list of Group II Services pursuant to Advt.

No 10/99 in contravention of the Judgment of the Honourable Supreme Court in Civil Appeal No.5099 of 2006 dated 18.2.2015 and selecting the petitioners to the post of Extension Officers PR Grade II after rendering more than 13 years of service in the post of Senior Accountant and its promotional post vide selection list dated 10.5.2018 is as illegal arbitrary unjust and violative of Articles 14 16 and 21 of the Constitution of India besides being opposed to all principles of natural justice equity and fair play and consequently set aside the selection list dated 10.5.

2018 insofar as the petitioners are concerned and hold that the petitioners are entitled to continue as Senior Accountants now Sub Treasury Officer / Junior Accounts Officer respectively with all consequential benefits and to pass such other order or orders as this Hon'ble Court may deem fit, just and proper in the circumstances of the case." SKK, J & AKS, J W.P.No.20579 of 2018 this stage as this Court had occasion to consider a similar issue in W.P.No.5419 of 2018 which was disposed of vide order dated 08.03.2018. A copy of the same is placed on record. Perusal of the afore-stated order reflects that this Court, upon being apprised that the issue raised in the writ petition was seized of by the Supreme Court, disposed of the writ petition directing the respondents to continue the petitioner therein in service in the existing post as per the willingness given by him pursuant to the communication received from the Andhra Pradesh Public Service Commission. It was also made clear that the same would be subject to the outcome of the case pending before the Supreme Court.

In terms of the afore-stated order, this writ petition is disposed of directing the authorities to continue the petitioners in service in their existing posts as per the willingness given by them in response to the communication received from the Andhra Pradesh Public Service Commission. The same would however be subject to the outcome of the decision of the Supreme Court in the pending case. Pending miscellaneous petitions, if any, shall stand closed in the light of the afore-stated order.
