THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8877 of 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.314 of 2014 on the file of Judicial First Class Magistrate, Pathikonda, Kurnool District. Heard the learned counsel appearing for the petitioners/A1 to A3 and the learned Additional Public Prosecutor representing the State.

Having perused the material on record, it is not a fit case to quash the proceedings. However, on the submissions of the learned counsel for the petitioner, this Court feels it appropriate to direct the Court below to dispose of the main C.C. itself as expeditiously as possible.

In that view of the matter, the Criminal Petition is disposed of directing the Judicial First Class Magistrate, Pathikonda, Kurnool District, to dispose of C.C.No.314 of 2014 within a period of six (6) months from today, without insisting for the presence of petitioners/A2 and A3 on each and every adjournment, unless the learned Magistrate feels that their presence is necessary for any specific purpose. Pending miscellaneous applications, if any, shall stand closed in consequence.
