SKK,J Crl.P_15590_2016 O R D E R:- This Criminal Petition is filed under Section 482 Cr.P.C. seeking to relax/ modify Condition No.(ii) imposed in the order dated 16.12.2013 in Crl.M.P.No. 2094 of 2013 in Crime No. 216 of 2013 passed by the Metropolitan Sessions Judge, Vijayawada and release the passport in favour of the petitioner.

The learned Additional Public Prosecutor appearing on behalf of the respondent-State, on instructions, has submitted that the petitioner is not arrayed as accused in the charge sheet, as such, he has no objection to the release of her passport.

In view of the averments made in this petition and the submission of the learned Additional Public Prosecutor, the trial Court is directed to release the passport of the petitioner on an application that may be moved by the petitioner for release of her passport.

Accordingly, this Criminal Petition is allowed. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
