HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.23758 OF 2019 ORDER:
This Writ Petition is filed questioning the inaction of respondent No.2 - Station House Officer, Kusumanchi Police Station, Kusumanchi, Khammam Disrict, in pursuance of the complaint of the petitioner dated 20.05.2019 as illegal and arbitrary.
2. Heard Sri V. Brahmaiah Chowdary, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 and 2, and perused the material on record.
3. Learned Assistant Government Pleader for Home based on the written instructions dated 13.11.2019, a copy of which is placed on record before this Court, would submit that pursuant to the petitioner's complaint dated 20.05.2019, an entry was made in the General Diary and was enquired into. In the enquiry, it is disclosed that the petitioner's complaint is a false one. Informing the same, respondent No.2 has issued a notice to the petitioner on 25.05.2019 stating that no action can be taken on her complaint as it is a false one and the said notice has been received by the petitioner. Suppressing the said fact, the present writ petition is filed.
4. Inasmuch as the 2nd respondent has already issued a notice to the petitioner informing her about the outcome of the enquiry based on her complaint, this Court is of the view that no further orders are
required to be passed in the matter. However, it is open for the petitioner to avail appropriate remedies in accordance with law.
5. With the above observations, the writ petition is closed. No order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the writ petition stand closed.
