THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR AND THE HON'BLE MS. JUSTICE J. UMA DEVI C.M.A.No.963 OF 2006 JUDGMENT: (per Hon'ble Sri Justice C. Praveen Kumar) The present Civil Miscellaneous Appeal, under Section 28 of the Hindu Marriage Act, 1955 (for short, 'the Act'), came to be filed by the appellant - wife assailing the order, dated 10.10.2006, in H.M.O.P.No.7 of 2002 passed by the Principal Senior Civil Judge, Tirupati, wherein a petition filed by the respondent - husband, under Section 13(1) of the Act, seeking divorce, was allowed.

2. By an order, dated 27.10.2006, this Court, while admitting the appeal, granted interim suspension of the impugned order. In view of the said interim order and as the respondent - husband died, pending the appeal, the appellantwife was provided with employment under compassionate grounds.

3. In view of death of the respondent - husband, we intend to close the appeal without going into the merits of the case.
