HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23701 OF 2019 ORDER:

This writ petition is filed challenging the proceedings in Lr.No.ADE/OP/D-27/MP/FNo.Sep-44/17 D.No.1435, dated 29-09-2017, wherein and whereby the petitioner was provisionally assessed to pay an amount of Rs.37,641/- and directed to pay 50% of the said amount for restoration of power supply and also directed to pay balance amount in two installments and the said assessment will be subject to determination of civil liability under Section 154 (6) of the Electricity Act (for short " the Act").

Learned counsel for the petitioner submits that there is no theft of energy occurred and that the respondents without following the procedure fixed the provisional amount. Heard Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 and 3.

Since the provisional assessment has been made subject to determination of civil liability by the appropriate Court under Section 154(6) of the Act and keeping in view of the facts and circumstances of the case, this Court is of the opinion that the writ petition can be disposed of directing the respondents to restore power supply to the petitioner on payment of Rs.9,000/- pending determination of further liability by the appropriate Court under Section 154 (6) of the Act.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 31-10-2019 Nvl
