HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8998 of 2017 ORDER:

Heard the learned counsel for the petitioner/Accused who is working as Asst. Executive Engineer-I & PR Department, Samachar Bhavan, at Hyderabad and also the learned Public Prosecutor representing the 1st respondent and perused the grounds urged in the quash petition and the contents of the First Information Report.

It is the contention of the learned counsel for the petitioner, leave about the other facts that even the child is allegedly at Karimnagar, whereas the petitioner is working at Hyderabad and there is no basis to say that the petitioner engaged the child much less committed offence of sec.370 or 374 IPC or the offences u/sec.75,80 and 81 of the Juvenile Justice (Care & Protection of Children) Act,2015.

Having regard to the above, there shall be stay of arrest of the petitioner pending investigation but investigation shall go on. The police are entitled to secure presence of the petitioner for purpose of investigation for which the petitioner is bound to attend.

Accordingly and in the result, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed.
