THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.32079 of 2017 ORDER:
This Writ Petition is filed for the following relief: "For the reasons mentioned in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue Writ, Order or Direction more particularly one in the nature of Writ of mandamus declaring the action of the Respondents particularly of Respondent Nos.5 to 7 threatening the petitioner to demolish structure bearing D.No.9-51(Old No.3-29, 3-29/1, 3-29/2 & 3-29/3) and H.No.9-50 (old No.3-27) are situated at Marikal Village and Mandal on the road leading from Mahabubnagar to Raichur, as illegal, arbitrary, violative of principles of natural justice and contrary to the specific provision contained under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and consequently direct the Respondents not to demolish & dispossess the petitioner from the above properties without following due process of law."
When the matter came up for admission on 21.09.2017, it was adjourned to 22.09.2017, on which date, the matter was taken up and was adjourned to after Dasara Vacation, 2017. Thereafter, the matter is listed today. Even as on date, there is no response from the respondents.
In those circumstances and considering the nature of grievance of the petitioner, without going into the merits of the matter, this Court disposes of the Writ Petition with the direction
CKR, J W.P.No.32079 of 2017 to the respondents not to threaten the petitioner to demolish the property in question or interfere with his possession over the same, without following due process of law.
