THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.30327 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The relief claimed in the present Writ Petition is similar to W.P.No.30162 of 2015, which is disposed of today. The petitioner herein claims to have purchased 9 ankanams or 81 sq. yards of site in Survey Nos.1756, 1757, 1758 and 1761 of Varada Nagar, Valayanandapuram, East Gudur, SPSR Nellore District, whereas the impugned notice refers that Ac.1.50 cents of land is encroached by the petitioner in Survey No.1761. The petitioner has already filed a detailed explanation on 09.09.2015 inter alia mentioning this aspect also.

In terms of the order referred to above, the Tahsildar, Guduru, SPSR Nellore District, the 4th respondent, shall consider and pass appropriate orders on the explanation of the petitioner. However, since the impugned notice is not with reference to the land in Survey Nos.1756, 1757 and 1758, no proceedings, except after following due process relating to objections, if any, for those lands, shall be initiated against the petitioner.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
