HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24039 of 2017 ORDER:

Heard Smt. P Hema Lalitha Kumari, for petitioners and the learned Assistant Government Pleader (Assignment) for respondents.

2. The prayer of petitioners relates to inaction of respondents 3 and 4 in considering and disposing of the representation dated 14.03.2016 made for grant of house site pattas in an extent of Ac.9.99 cents in Sy.No.94 situated at Velanka Village, Kirlampudi Mandal, East Godavari District.

3. On 20.07.2017, at request of respondents, the writ petition was adjourned and directed to be taken up today. The Assistant Government Pleader refers to the written instructions dated 22.07.2017 of 3rd respondent and submits that the representation cannot and could not be considered for two reasons, namely, one , permission from the Irrigation Department and secondly, Sy.No.94 is classified as ' Ayya Cheruvu'.

4. The prayer is inaction of 4th respondent in disposing of representation. The 4th respondent ought to have considered the eligibility of the petitioners, if not in Sy.No.94, at least at any other place, where house site pattas are granted by the Department, taken a decision and communicated to them. The Assistant Government Pleader submits that the 4th respondent would look into the representation for assignment of pattas not only in Sy.No.94 but with reference to other vacant house sites available in the village, consider and take a decision on the request of the petitioners for allotment of house site pattas,

within two months from today. The statement is placed on record and accepted.

4. The writ petition is disposed of accordingly. The petitioners, on communication, if aggrieved, are always free to work out their remedies in accordance with law. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
