HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1791 of 2015 ORDER:

After hearing both sides, at the admission stage, the following order is passed.

Having regard to the fact that the charge sheet is filed, case is committed to the Sessions Court and numbered as S.C.No.41 of 2011 and coming up for framing of charges, it is not a fit case to quash the proceedings at this stage. However, the petitioner/A2, if advised, is at liberty to file discharge application, putting forth all the defences available to him under law, in which case, the trial Court shall pass an appropriate order on his application on merits at the earliest. Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
