The grievance of the petitioner is that respondents 3 and 4 are not registering the FIR on the complaint made by the petitioner. Aggrieved by the same, the present writ petition is filed. Learned Assistant Government Pleader for Home produced written instructions stating that the complaint of the petitioner was enquired into and non-cognizable offence is made out and the same was communicated to the petitioner, but the same is disputed by learned counsel for the petitioner. .

Learned counsel for the petitioner says that the allegations leveled against the 5th respondent and others in the complaint dated 19-04-2018 constitute the offence punishable under Section 67 of the Information Technology Act, which is a cognizable offence. In view of the same, the police are directed to take necessary action on the complaint of the petitioner in terms of guidelines laid down in the judgment of Apex Court in Lalitha Kumari v. Government of Uttar Pradesh1.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
