THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.6343 of 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/accused No.1, for grant of anticipatory bail in the event of his arrest in Crime No.43 of 2016 of Ulindakonda Police Station, Kurnool District, registered for the offences punishable under Sections 509, 323, 354 and 420 read with IPC. 2.

Heard the learned counsel for the petitioner/accused No.1, learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioner/accused No.1 argued at length with regard to the allegations levelled against the petitioner. He further contended that all material witnesses were examined in this case and there is no possibility to the petitioner to win over the witnesses and hence, he prays to grant bail to the petitioner/accused No.1.

On the other hand, learned Additional Public Prosecutor opposed the bail application and brought to the notice of this Court the earlier bail application of the petitioner was dismissed by this Court vide order, dated 03.01.2018, in Crl.P.No.12526 of 2017. 5.

The contentions now raised by learned counsel for the petitioner/accused No.1 were already discussed in the earlier order, dated 03.01.2018 in Crl.P.No.12526 of 2017. Since there are no changed circumstances, the petitioner is not entitled to bail. The contention of learned counsel for the petitioner that all material

witnesses were examined is not a ground to grant bail to the petitioner/accused No.1 in view of specific allegation against him and gravity of offence.

The Criminal Petition is, accordingly, dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
