THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8197 OF 2016

O R D E R

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in D.V.C.No.4 of 2016 on the file of II Metropolitan Magistrate, Cyberabad at L.B. Nagar, Rangareddy District, filed against the petitioners / accused 1 to 3, for offence punishable under Sections 18,19, 20 and 22 of the Domestic Violence Act, 2005.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order. The presence of petitioners 2 and 3 / accused 2 and 3, shall not be insisted upon unless required for any specific purpose during the course of trial.

Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:15.06.2016 AVS
