THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8522 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail to the petitioner/Accused in Crime No.5 of 2023 on the file of Station House Officer, Allapur Police Station, Allapur, Cyberabad District registered for the offence punishable under Section 452, 386, 506, 509 read with 34 of Indian Penal Code.

Heard learned counsel for petitioner and learned Assistant Public Prosecutor for respondent-State. Perused the record. 3.

The case of the defacto complainant is that the petitioner and others trespassed into their house and vandalized the house by breaking furniture and also taken away an Iphone and Laptop and also threatened the defacto complainant at knife point. 4.

As seen from the complaint, there are disputes with regard to shares in the property. It is evident from the complaint that A1 had purchased the share in the company, thereafter the dispute arose.

In the complaint, it is mentioned that Accused No.1 along with other trespassed into his premises.

Keeping in view there are business disputes between the defacto complainant and Accused No.1, and there are no specific allegations against the petitioner/A2, the petitioner/A2 can be granted the relief of Anticipatory Bail.

Accordingly, the Criminal Petition is allowed and the petitioner/A2 shall be enlarged on bail subject to the following conditions:

i) The petitioner/A2 is directed to surrender before the Station House Officer, Allapur Police Station, Allapur, Cyberabad District on or before 14.09.2023, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties to the like sum each, to the Station House Officer satisfaction. ii) The petitioner/A2 shall appear before the concerned Station House Officer on every Monday between 10.00 AM and 01.00 PM for a period of two (02) months, for the purpose of investigation.

iii) The petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
