THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23520 of 2013 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondents in issuing notice inviting tender bearing No.PDS/Moment/5(2)213-14/stage 1, dated 03.08.2013, as contrary to their conditions and also contrary to Article 14 of the Constitution of India by restricting the participation of tenderers, as illegal and arbitrary and consequently direct the respondents to issue fresh notification by calling tenders with reduced amounts of deposits.

Heard and perused the material available on record. 3.

It is informed by the learned Standing Counsel for the respondent Corporation that the tender is pertaining to the year 2013 and that the tender process is also over. 4.

On perusal of the record, it is evident that no interim order is passed staying all further proceedings of notice inviting tender bearing No.PDS/Moment/5(2)213-14/stage 1, dated 03.08.2013 and since the tender process is also over, this Court is of the view that nothing survives in this writ petition for adjudication and the writ petition is liable to be dismissed as infructuous.

Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ RAJA ELANGO,J Date: 20th April, 2017 KL
