HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9288 of 2017 ORDER:

This Criminal Petition is filed, by the petitioner-accused under Sections 437 and 439 of Cr.P.C., seeking regular bail in Crime No.08 of 2017 on the file of Station House Officer, Proddatur Police Station, Kadapa District, registered for the offence punishable under Section 302 IPC.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated in this case. 3.

Learned Additional Public Prosecutor submitted that the investigation is in progress; therefore, it is not a fit case to grant bail to the petitioner.

The case of the prosecution is that Chagari Chandrasekhar Reddy (hereinafter referred to, as the deceased) developed illicit intimacy with the wife of the petitioner. The petitioner hatched up a plan to kill the deceased. In pursuance thereof, the petitioner brutally murdered the deceased.

The petitioner filed Crl.M.P.No.1596 of 2017 on the file of II Additional Sessions Judge, Kadapa at Proddatur and the same was dismissed on 15.09.2017 on the ground that the investigation is in progress.

A perusal of the record prima facie reveals the role played by the petitioner in the commission of offence. Whether the petitioner was falsely implicated or not will come to light during the course of investigation. A perusal of the record reveals that the investigation

is in progress. As rightly pointed out by learned Additional Public Prosecutor if the petitioner is released on bail, the possibility of threatening the prosecution witnesses cannot be ruled out completely.

Taking into consideration the gravity of the offence alleged to have been committed by the petitioner and the stage of investigation, this Court is of the considered view that it is not a fit case to grant bail to the petitioner.
