HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23741 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " .....to issue a writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent in issuing the auction notification No.Vacant flat/ House/ office Accommodation/ Auction/ EE(WD)KKP/ 2018-2019 without considering the claim of the petitioner for allotment of any flat in Block 2 and 3 (B/ 501, B3/ 307 and B3/ 802) in lieu of the present allotment made in Block 1/ 204 as illegal, arbitrary, without jurisdiction and against the earlier notifications and consequently direct the respondents herein to allot and give possession of any of the flats in Block 2 and 3 (B/ 501, B3/ 307 and B3/ 802) in lieu of the present allotment made in Block 1/ 204 pursuant to the letter dt.5.10.2017......" . Heard Mr.S.A.Razzaak, the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

It has been contended by the petitioner that she was allotted a flat in Block No.1/ 204.

Thereafter, she has submitted representations to the respondents on 28.10.2019 and 29.10.2019 requesting to consider her case for allotment of a flat in Block Nos.2 and 3. But, so far, the respondents have not passed any orders on the said representations nor allotted flat as sought by her. Learned counsel appearing for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner and pass appropriate orders in accordance with law. Learned Standing Counsel appearing for the respondents contended that for left over flats, the respondents are conducting

public auction and if the petitioner is willing to participate in the said public auction, it is always open for her to participate in the said public auction. However, since the representations of the petitioner are pending, the respondents would consider the same and pass appropriate orders in accordance with law. This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 28.10.2019 and 29.10.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
